Last updated: April 13, 2026

Acceptance of Terms

PicVaultPro is owned and operated by Open Key Technologies LLC, a Montana limited liability company (“we,” “us,” or “our”). By accessing and using PicVaultPro, you accept and agree to be bound by these Terms of Service.

Use of Service

You agree to use PicVaultPro only for lawful purposes and in accordance with these Terms. You are responsible for all content you upload and share.

Storage and Fair Use

All storage plans are subject to fair-use policies. Storage limits are defined by your subscription tier. Additional storage can be purchased as add-on blocks.

Prohibited Content

You may not upload, store, transmit, request, or trade content that is illegal, exploitative, or violates the rights of others. This includes, without limitation:

  • Child sexual abuse material (CSAM), child exploitation material, or any sexual content involving minors (including attempted grooming, solicitation, or trafficking activity)
  • Non-consensual intimate imagery, extortion, or harassment
  • Material that violates intellectual-property, privacy, or other applicable laws

Prohibited content and behavior are forbidden regardless of whether files are encrypted.

Child Safety

To protect minors and comply with applicable law, PicVaultPro prohibits child sexual abuse material (CSAM) and other child exploitation content and acts on reports of it. By using our Services, you acknowledge and agree to the following:

  • Detection today: We do not currently run automated scanning on uploads. Photo and video contents are encrypted on your device before upload. We plan to add on-device detection of known CSAM and will update these Terms before it starts.
  • No circumvention: You may not attempt to bypass, disable, interfere with, or circumvent any content safety scanning mechanisms. Any such attempt constitutes a material breach of these Terms.
  • Encrypted files: Our safety measures do not grant PicVaultPro or any third party access to your encrypted files.
  • False positives: In rare cases, content may be incorrectly flagged. If your upload is blocked and you believe it was flagged in error, you may contact us at safety@picvaultpro.com for review. We will respond within 5 business days.

Mandatory Reporting Under Federal Law

Under 18 U.S.C. § 2258A, we are legally required to report apparent violations involving CSAM to the NCMEC CyberTipline. By using our Services, you acknowledge that:

  • When we become aware of apparent CSAM, we are obligated to file a CyberTipline report with NCMEC, which may be forwarded to law enforcement. We have no discretion to decline or delay mandatory reports.
  • Reports include all information required by law, which may include: the offending content, associated account information (email, IP address, account creation date), upload timestamps, and any other relevant metadata.
  • We cooperate fully with law enforcement investigations related to child exploitation, including responding to valid subpoenas, court orders, and other legal process.

Evidence Preservation

Where the law requires PicVaultPro to preserve material relating to CSAM or suspected child exploitation, we will do so:

  • Where required, we will isolate reported content from user access and preserve it for inclusion in NCMEC reports and law enforcement requests.
  • Where required, we will preserve associated account records, access logs, IP addresses, device information, and upload metadata for the period the law requires (see 18 U.S.C. § 2258A(h)), or longer if an active investigation or legal hold requires.
  • You may not delete, alter, or attempt to destroy any content or account data that is subject to a legal hold or active investigation.

Account Termination

We may immediately suspend, restrict, or terminate accounts that violate these Terms. We may also place related accounts, uploads, metadata, and logs on legal hold to preserve evidence and comply with legal obligations.

CSAM-specific enforcement: Any account found to contain CSAM or to be engaged in child exploitation activity will be immediately and permanently terminated without prior notice. This includes:

  • Immediate suspension of all account access
  • Preservation of all account data for law enforcement
  • Filing a CyberTipline report with NCMEC
  • Permanent ban from creating new accounts
  • No refund of any prepaid subscription fees

Legal Process and Cooperation

PicVaultPro cooperates with valid legal process and may disclose information as required by law. In addition to mandatory CSAM reporting, we may disclose account information in response to:

  • Valid subpoenas, search warrants, and court orders
  • Emergency requests from law enforcement involving imminent danger to a child
  • Requests from NCMEC or the Internet Crimes Against Children (ICAC) task forces

We may preserve relevant account records, audit data, and associated artifacts while an investigation is active or legally required.
